In-N-Out Burger is coming to American Fork.

The news of the restaurant’s opening came Wednesday during a city Planning Commission meeting in which commissioners were talking about the site plan for the Doug Smith Autoplex, at 523 W. Main St. A representative at the meeting said the restaurant could open as early as October.

The news comes days after the restaurant chain announced it had plans to open a location in Draper. The Draper restaurant will be located in the Draper Peaks Shopping Center, at 12195 So. Factory Outlet Dr., according to a Draper City press release. The company only has one Utah location now, in the St. George area.

American Fork is also home to Chadder’s, which was sued by In-N-Out in 2007 because the chain claimed the American Fork restaurant infringed on its company trademarks. The two companies reached a confidential settlement in October 2007. Before the case was settled, a judge issued a temporary restraining order to Chadder’s, requiring it to stop selling, advertising and accepting orders using In-N-Out trademarked burger names.
